Terms of Use

1. Agreement

These terms are an agreement between you and Bobe Media ("we", "us"), based in Ontario, Canada, for your use of the Babu app and babubaby.app (together, "Babu"). By using Babu, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Babu.

2. Who can use Babu

You must be at least 18 (or the age of majority where you live) to create an account. You're responsible for keeping your sign-in secure and for activity on your account.

3. Not medical advice

Babu provides general parenting information, tracking tools, and estimates based on typical ranges and your own logs, such as nap windows, daily plans, stage cards and patterns. This information is for general wellness and organization only. It is not medical advice, and it does not diagnose, treat or prevent any condition. Every baby is different. Always talk to a qualified healthcare provider about your baby's health, and call your doctor or emergency services right away if you're worried. Never delay seeking care because of something you saw in Babu.

4. Family sharing

You can invite a partner or caregiver to your family. Anyone you invite can see and add to your baby's information, so only invite people you trust. The family owner can remove members at any time. If family members disagree about access to a family's data, we may ask for information to confirm who should control it.

5. Babu Plus subscriptions

• Babu Plus is an optional subscription, offered monthly or yearly. Prices are shown in the app before you buy and may vary by country.
• Payment is charged to your Apple ID account when you confirm the purchase. Apple handles all billing.
• Free trial: if you start a free trial, it converts to a paid subscription at the end of the trial unless you cancel at least 24 hours before it ends.
• Auto-renewal: your subscription renews automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period.
• Cancel anytime in your iPhone's Settings → [your name] → Subscriptions. Cancelling stops future renewals; you keep Plus until the end of the period you paid for.
• Refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com.
• One subscription covers everyone in your Babu family.
• If we change prices, we'll give you notice as required by Apple and applicable law.

6. Beta testing

If you join the Babu beta through Apple TestFlight, you're using a pre-release version that may have bugs, change often, or lose data. Please don't rely on the beta as your only record. Feedback you send helps us improve Babu, and you agree we can use it without owing you anything.

7. Your content

You own the information you add to Babu. You give us permission to store, process and display it only as needed to run Babu for you and your family, as described in our Privacy Policy. You can export or delete your data at any time.

8. Acceptable use

Please don't misuse Babu. For example, don't try to access other families' data, interfere with or reverse-engineer the service, use it for anything illegal, or upload content that isn't yours to share.

9. Our rights

Babu, including its design, code, content and the Babu name and logo, belongs to Bobe Media. These terms give you a personal, non-transferable licence to use Babu for your own family; they don't give you any other rights to it.

10. Changes and availability

We're constantly improving Babu, so features may change, be added or be removed. We'll try to keep Babu available, but we can't promise it will always be uninterrupted or error-free. We'll give reasonable notice before discontinuing Babu, along with a way to export your data.

11. Disclaimers

To the extent permitted by law, Babu is provided "as is" and "as available", without warranties of any kind, including that estimates or plans will be accurate for your baby.

12. Limitation of liability

To the extent permitted by law, we aren't liable for indirect, incidental or consequential damages, or for loss of data, arising from your use of Babu. Our total liability for any claim is limited to the greater of the amount you paid for Babu Plus in the 12 months before the claim, or $50 CAD. Nothing in these terms limits rights you have under consumer protection laws that can't be waived.

13. Ending your use

You can stop using Babu and delete your account at any time. We may suspend or end access if you seriously or repeatedly break these terms, and we'll tell you why unless the law prevents us.

14. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. If you live elsewhere, you also keep any protections your local consumer laws give you.

15. Apple App Store terms

These terms are between you and Bobe Media, not Apple. Apple is not responsible for Babu or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claims relating to it, including product liability, legal or regulatory claims, or intellectual property claims. If Babu fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); Apple has no other warranty obligation. You confirm you're not located in a country subject to a U.S. government embargo and are not on a U.S. prohibited-party list. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

16. Changes to these terms

If we make important changes, we'll let you know in the app or by email before they take effect. Continuing to use Babu after that means you accept the updated terms.
